An appeal against the High Court ruling that unincorporated bodies/groups like residents associations can take judicial review proceedings to appeal planning decisions on environmental grounds was heard by the Supreme Court yesterday.  The right of Sandymount and Merrion Residents Association (SAMRA) to challenge the An Bord Pleanala decision to grant permission for the extension of the Ringsend sewage treatment plant in Dublin was appealed by the State with Dublin City Council as a notice party supporting the State. The State are of the view that an unincorporated association cannot bring a judicial review of a planning decision. Heretofore the only way for an association or group appeal decisions by An Bord Pleanala was for one person to take the case on behalf of the group and for that one person to bare all the financial risk. This decision has major implications for residents groups all over the country.  The residents are relying on the provisions of the Aarhus Convention which was designed to improve public participation in decision-making and remove procedural hurdles in providing access to justice. The Supreme Court reserved its decision until Thursday 10^th October 2013.

Kildare County Council has given notice that it proposes to prepare Local Area Plans for Kilcullen, Monasterevin, Sallins, Kilcock and Clane. Pre-draft submissions and observations from interested parties in relation to these towns are now invited.   An Issues Paper has been prepared which identifies the key planning issues that the five local area plans could address.

Submissions should be made in writing to Mary Foley, Administrative Officer, Forward Planning, Kildare County Council, at the address below or emailed to lapsubmissions@kildarecoco.ie by 5pm on Wednesday 6 March 2013.

The Draft Meath County Development Plan 2013-2019 has been prepared and is on public display from Friday 25th May 2012 to Friday 3rd August 2012 inclusive.

Written submissions or observations with respect to the Draft Development Plan and/or Environmental Report and/or Appropriate Assessment are invited from members of the public and other interested parties between Friday, 25th May 2012 and Friday, 3rd August 2012 inclusive.  Observations/Submissions must be received by 4.00pm on Friday, 3rd August 2012.

The public consultation will take place from 17th July 2012 to 4.00p.m on 3rd September 2012, inclusive. The proposed Local Area Plan and Environmental Reports can be viewed on the Council’s website at www.southdublin.ie and can also be viewed at County Library and County Hall, Tallaght, and at the Civic Offices, Clondalkin, during normal opening hours [excluding public holidays].

Submissions and observations on the proposed Local Area Plan and the

Environmental Report can be made in writing only to the addresses below from 17th July 2012 to 4.00p.m. 3rd September 2012.

Kildare County Council has prepared a Local Area Plan for Kildare Town.

Copies of the proposed Local Area Plan and Environmental Reports may be inspected for a period of 6 weeks from 7 June 2012 to 18 July 2012 inclusive at the following locations:

Kildare County Council: 9.00 a.m. – 4.00 p.m., Monday to Friday

Kildare Town Branch Library: Tuesday and Wednesday 2.00pm to 5.00pm; Thursday 1.00pm to 8.00pm; Friday 9.30am to 1.00pm and 2.00pm to 5.00pm; Saturday 9.30am to 12.30pm

A plan that envisages three new villages for Dublin has gone on public display. The draft Planning Scheme for the Cherrywood Strategic Development Zone (264 hectares), put forward by Dún Laoghaire Rathdown County Council, proposes three new villages, a town centre and an employment base to potentially accommodate over 17,000 workers. The scheme will be on public display for six weeks at the council’s offices at Dún Laoghaire and Dundrum before it is returned to councillors for consideration. Last submissions 11th April 2012.

Kildare County council have issued a Notice of Proposed Variation of Kildare County Development Plan 2011-2017.  The variation seeks to incorporate the following Small Town Plans: Kill, Prosperous, Rathangan, Athgarvan, Derrinturn, Castledermot into the County Development Plan 2011-2017.

Written submissions in relation to the proposed Variation may be made before 5pm FRIDAY 9 MARCH 2012.

The draft Carlow Town Development Plan 2012 – 2018 has gone on public display and submissions are now being sought on same. 

The Draft Carlow Town Development Plan includes parts common to the Draft Joint Spatial Plan for the Greater Carlow Graiguecullen Urban Area 2012-2018 currently being prepared on a joint basis by Carlow Town Council, Laois County Council and Carlow County Council and will comprise of the Carlow Town Development Plan, Graiguecullen Local Area Plan and Carlow Town Environs Local Area Plan.

Written submissions or observations with respect to the Draft Carlow Town Development Plan may be made to the Planning Department before 5.00 p.m. on Friday 27th April 2012.

Dublin City Council has prepared a Draft Local Area Plan for the George’s Quay Area, Dublin 2.

The City Council are inviting interested parties or individuals to make submissions or observations with respect to the Draft Local Area Plan during the public consultation stage. A series of public consultation sessions in Pearse Street Library have also been organised in the local area to coincide with the observation period.

Submissions are due before 4.30pm on Friday 30th March 2012.
